1. Who We Are

 

These Website Terms & Conditions (the “Terms”) govern your use of the website operated by BuildHer VII Holdings, LLC and its divisions, including BuildHer & Co. (Paint & Signature Finishes), BuildHer Site & Prep, and BuildHer Signature Clean‑Up & Restoration (collectively, “Company,” “we,” “us,” “our”).

 

2. Acceptance of These Terms

 

By accessing or using our website, requesting a quote, booking a walkthrough, submitting a form, or otherwise interacting with our online services, you agree to be bound by these Terms and our Privacy Policy (linked in the site footer). If you do not agree, do not use the site.

 

3. Informational Content; No Professional Advice

 

The site’s content is for general informational and marketing purposes only. It may describe services we typically offer but is not a promise of availability for any specific project. Estimates, calculators, visuals, and articles are not guarantees or professional advice.

 

4. Scope of Services; Licensing Note (Florida)

 

We focus on cosmetic, coating, and cleaning scopes (e.g., painting, wallcoverings, epoxy/resinous floor coatings, pressure washing, and construction cleaning). We do not perform structural or trade‑licensed work (e.g., roofing, electrical, plumbing, HVAC, drywall installation/finishing, waterproofing, or mold assessment/remediation). Where such work is needed, it must be contracted to and performed by properly licensed contractors (often through the GC/Owner). Availability varies by jurisdiction.

 

5. Quotes, Proposals & Online Requests

 

* Requests. Sending a request does not create a contract. We may contact you for more information or to schedule a walkthrough.

Estimates. Estimates are based on information available at the time and are subject to change after site inspection, substrate testing, or plan review.

* Proposals/Work Orders. A binding agreement arises only when you receive and accept a written proposal or work order from us (including e‑signature) and satisfy any stated conditions (e.g., deposit).

* Exclusions. Hidden conditions (e.g., moisture intrusion, substrate failure, environmental hazards) are excluded unless specifically noted and may require change orders.

 

 

6. Scheduling, Access & Site Readiness

 

You agree to provide timely site access, utilities (power/water), elevator/loading access, and clear work areas. Work may occur during daytime or agreed quiet hours. If access is delayed, unsafe, or not as described, we may pause work and adjust schedule/price accordingly. For occupied or operational facilities, you agree to coordinate notifications and safety restrictions.

 

 

7. Safety & Environmental

 

We maintain jobsite housekeeping and follow reasonable safety practices. You agree not to request or require work that violates safety regulations. We do not handle or remediate hazardous materials, including lead, asbestos, or mold; discovery of such conditions triggers a stop‑work and referral to qualified parties. Pressure washing and chemical treatments carry inherent risks to sensitive substrates; we follow manufacturer guidance, but pre‑existing conditions or incompatible materials may limit results.

 

 

8. Payments, Changes & Cancellations (If Using Online Payments)

 

* Payments - Invoices are due per the proposal (e.g., Net‑30 or progress billing). Late amounts may accrue administrative/finance charges as permitted by law.

* Deposits - Deposits (if required) reserve crew time and materials and are typically non‑refundable once procurement starts.

* Changes - Changes in scope/schedule require written approval; time and price adjustments apply.

* Cancellations/Delays - If work is cancelled or delayed less than \[X] business days before start, we may charge reasonable mobilization/remobilization or restocking costs.

* Chargebacks - Unapproved chargebacks are a breach of these Terms; disputes must follow the Dispute Resolution section.

 

9. Warranties & Disclaimers

 

* Workmanship - Unless otherwise stated in a proposal, we provide a limited workmanship warranty of \[12 months] on cosmetic scopes. Manufacturer warranties govern materials.

* Exclusions -Normal wear, abuse, impacts, moisture intrusion, substrate movement/failure, efflorescence, incompatible prior coatings, and acts of God are excluded.

* No Other Warranties. EXCEPT AS EXPRESSLY STATED, THE SITE AND SERVICES INFORMATION ARE PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND.

 

10. Limitation of Liability

 

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SITE OR A PROJECT SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE PROJECT GIVING RISE TO THE CLAIM (OR USD $1,000 IF NO PROJECT FEE APPLIES). WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, COVER, OR PUNITIVE DAMAGES.

 

11. Indemnification

 

You agree to defend, indemnify, and hold harmless the Company and its managers, employees, and agents from claims arising out of (a) your misuse of the site; (b) your breach of these Terms; or (c) site content you submit.

 

12. Intellectual Property

 

All site content, logos, graphics, text, photos, icons, and layouts are owned by or licensed to us and protected by IP laws. You may not copy, modify, or exploit site materials without written consent. Limited, revocable permission is granted to link to public pages in a manner that is fair and non‑misleading.

 

13. User Content; Feedback; Photo Permissions

 

If you send ideas, reviews, or materials, you grant us a non‑exclusive license to use them for marketing and service improvement, with attribution at our discretion. We may take before/after photos of our work; unless you email opt‑out before project completion, you grant us permission to use such photos in marketing, provided we do not disclose confidential information or identify occupants without consent.

 

14. Third‑Party Links & Tools

 

The site may link to third‑party sites or tools. Those are provided for convenience and are not controlled by us. Your use of third‑party services is at your own risk and subject to their terms.

 

15. Electronic Communications; E‑Sign Consent

 

By using the site and providing your contact details, you consent to receive emails, calls, and texts related to your inquiries and projects. Message/data rates may apply. Reply STOP to end SMS. You agree that e‑signatures and electronic records have the same legal effect as ink signatures (to the extent permitted by law).

 

16. Privacy

 

Our Privacy Policy explains how we collect, use, and share information. By using the site, you consent to our data practices described there. Do not submit confidential or sensitive information through unencrypted forms.

 

17. Compliance; Geographic Limits

 

We offer services where we are properly registered and insured and where our crews can safely work. Nothing on the site is a solicitation to perform services in a jurisdiction where doing so would be unlawful.

 

18. Dispute Resolution; Governing Law

 

These Terms are governed by the laws of the State of Florida, without regard to conflict‑of‑laws rules. Venue for claims that proceed in court shall lie in the state or federal courts located in [Saint Lucie County, Florida].

 *Arbitration Enabled:* Any dispute shall be resolved by binding arbitration conducted by \Named Provider in Saint Lucie County, on an individual basis (no class actions). Judgment may be entered on the award.

 

 *Arbitration Disabled:* Parties agree to good‑faith negotiation and, if needed, non‑binding mediation before filing suit.

 

19. Force Majeure

 

We are not liable for delays or failures caused by events beyond our reasonable control, including severe weather, supply chain disruptions, labor issues, power outages, or acts of God.

 

20. Changes to the Site or These Terms

 

We may update the site and these Terms at any time. The “Effective Date” reflects the latest revision. Your continued use after changes means you accept the updated Terms.
